Millennium Decking Inc. (MDI) warrants it’s products
to be free from manufacturing defects for a twenty (20)
year period from the date of purchase subject to the
following limitations and conditions. This warranty
extends to the value of the material only, and does
not include labour charges or other expenses whatsoever
in connection with removal or installation of either
the original or replacement product. At MDI’s
option, this warranty is for the replacement or refund
of the original sale price of the defective portion
of the material. This warranty applies to the original
purchaser and/or owner and is not transferable.
The purchaser and/or owner are solely responsible for
determining the suitability of MDI’s products
for its intended application, including applicable building
codes, good construction practices and safety regulations.
Limitations: This warranty does not provide protection
against any failure or damage caused by situations &
events including but not limited to:
MDI’s products are not warranted against discoloration
or against damage caused by air pollution (including
but not limited to metal oxides or metallic particles),
exposure to chemicals or weathering from the elements.
MDI’s products are not warranted against soiling
including ground in dirt, berry stains, rust, grease,
or stains burned into the deck. MDI’s products
are not warranted as a waterproofing membrane including
when the joints are caulked. MDI shall not be liable
or responsible for variations in the colour, gloss,
or surface texture variations from plank to plank. MDI’s
products will vary in appearance in the same manner
as wood.
MDI reserves the right to discontinue or modify any
of its products without notice to the purchaser and/or
owner, nor shall MDI be liable in the event material
may vary in colour, gloss or surface texture in comparison
to the original product. If MDI replaces any material
under this warranty, it may substitute products designated
by MDI to be of comparable quality or price range in
the event the product initially installed has been discontinued
or modified.
WHAT THE PURCHASER and/or OWNER MUST DO: The purchaser and/or owner must promptly notify MDI
in writing of any manufacturing defect and provide proof
of the purchase date and installation as well as proof
of property ownership. The purchaser and/or owner may
be required to submit a sample of the defective material
to MDI for analysis. MDI will then investigate the claim
and may examine the material claimed to be defective.
If a defect covered by this warranty is confirmed, MDI
within a reasonable amount of time after the inspection,
will provide replacement material or refund the amount
paid by the original purchaser and/or owner for the
product, per the terms of this warranty.
THIS WARRANTY REPLACES ALL OTHER ORAL OR WRITTEN WARRANTIES,
LIABILITIES OR OBLIGATIONS OF MILLENNIUM DECKING INC.
PERTINENT STATE OR PROVINCIAL LAW SHALL CONTROL FOR
WHAT PERIOD OF TIME, FOLLOWING THE SALE, A PURCHASER
AND/OR OWNER MAY SEEK A REMEDY UNDER THE IMPLIED WARRANTY
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL MILLENNIUM DECKING INC. BE LIABLE
FOR CONSEQUENTIAL OR INCIDENTIAL DAMAGES OF ANY KIND,
INCLUDING ANY DAMAGE TO THE BUILDING, OR ANY PERSON
THEREIN, RESULTING FROM THE BREACH OF THIS WARRANTY.
MILLENNIUM DECKING INC. DOES NOT AUTHORIZE ITS REPRESENTATIVES,
DISTRIBUTORS OR DEALERS TO MAKE ANY CHANGE OR MODIFICATION
TO THIS WARRANY. SOME STATES OR PROVINCES DO NOT ALLOW
LIMITATIONS ON, OR THE EXCLUSION OF, INCIDENTIAL OR
CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS MAY NOT
APPLY TO YOU.
- Misuse, abuse, neglect or improper handling or
storage.
- Improper installation or installation not in strict
adherence to MDI’s written instructions.
- Impact of foreign objects, fire, earthquake, flood,
lightning, hail, hurricane, or other casualty or act
of God.
- Movement, distortion, collapse, or settling of
the ground or structure on which the product is installed.
- Any other cause not involving manufacturing defects
in the material.
This warranty is effective January 1, 2003.
This warranty gives you specific legal rights, and
you may also have other rights, which may vary from
state to state or province to province. |
